1. Acceptance of Terms

1.1 Your access to or use of the Platform, in any form, constitutes your full and unconditional agreement to these Terms and to all legal notices contained in them.

1.2 If you do not agree to any provision of these Terms, you must immediately stop using the Platform and not access it.

1.3 You must be legally competent to enter into a binding contract under applicable law in order to use the Platform.

2. Nature of the Service

2.1 The Platform is an independent smart tool that uses artificial intelligence for flight price comparison only, operated solely by its owner and not a company with a staff of employees. Its sole function is to display indicative prices for business-class and first-class flights of two airlines, Emirates (EK) and Etihad Airways (EY), across a number of possible departure airports, in order to show that departing from a nearby airport may cost less for the same premium cabin.

2.2 The Platform is not a travel agency, is not a booking site, is not an airline, and is not an intermediary in any sale. We do not sell or issue tickets, and we do not process any booking.

2.3 The Platform is fully independent and is not affiliated with, sponsored by, or connected to Emirates or Etihad Airways in any way, and there is no partnership or agency relationship between us and them.

2.4 To complete any booking, the user proceeds to the direct booking site and completes the booking there. Any travel contract is formed between you and the airline or the relevant booking provider, and we are not a party to it.

3. No Guarantee of Prices or Availability

3.1 All prices displayed on the Platform are indicative only. They are sourced from licensed third-party data providers and may be delayed, inaccurate, subject to change, or unavailable.

3.2 The final price is whatever the airline actually charges at the time of booking on the direct booking site, and that is the only authoritative reference. This price may differ from what is displayed on the Platform, and we bear no responsibility for any such difference.

3.3 Seat availability, fare classes, and cabins are entirely controlled by the airline and may change or sell out at any moment without notice.

3.4 We are not a party to any transaction between you and the airline, and we do not guarantee the completion of any booking or the availability of any displayed price.

4. Disclaimer of Warranties

4.1 The Platform and all of its content and services are provided "as is" and "as available", without any warranty of any kind, whether express or implied.

4.2 To the maximum extent permitted by law in the United Arab Emirates, we disclaim all warranties, including warranties of accuracy, completeness, timeliness, availability, continuity of operation, freedom from error, or fitness for a particular purpose.

4.3 We do not warrant that the service will be uninterrupted, secure, or free of faults or outages, or that the displayed results will be correct or up to date.

5. Limitation of Liability

5.1 To the maximum extent permitted by law in the United Arab Emirates, neither the Platform nor its owner and operator shall be liable for any direct, indirect, incidental, consequential, special, or punitive damages.

5.2 This includes, without limitation, any loss of anticipated savings, a missed deal, a difference in price, a booking problem, a decision you made in reliance on a price displayed on the Platform or on its availability, or any harm arising from your use of, or inability to use, the Platform.

5.3 If our liability is nonetheless established at law despite the foregoing, our total aggregate liability to you, for all claims combined, shall be limited to the amount you actually paid us during the three (3) months immediately preceding the event giving rise to the claim, or to one hundred UAE dirhams (AED 100), whichever is lower.

5.4 These limitations apply to the fullest extent permitted by law. Where the law does not allow the exclusion or limitation of a particular liability, our liability shall be limited to the narrowest scope permitted by law.

6. Indemnification

6.1 You agree to indemnify, defend, and hold harmless the Platform and its owner and operator from any claim, loss, liability, cost, or expense (including reasonable legal fees) arising out of or connected with: (a) your misuse of the Platform; (b) your breach of these Terms; or (c) your violation of any applicable law or any right of a third party.

7. Acceptable Use and Anti-Abuse

7.1 You are strictly prohibited from accessing the Platform or any part of it by any automated means, including bots, crawlers, scrapers, or any tool for harvesting, extracting, or automatically indexing data.

7.2 You are prohibited from reverse engineering the Platform, decompiling or disassembling its software, or attempting to derive or extract its source code, algorithms, or structure in any form.

7.3 You are prohibited from testing, probing, or breaching the security of the Platform, or from gaining unauthorized access to any part of it, to other users' accounts, or to our systems or data.

7.4 You are prohibited from circumventing the token (credit) system, exceeding usage limits or rate limits, or bypassing any technical or security restriction by any method.

7.5 You are prohibited from reselling, republishing, redistributing, or licensing the data displayed on the Platform, from reselling access to the Platform, or from exploiting it commercially without our prior written permission.

7.6 You are prohibited from making any fraudulent payment, or from abusing the refund or chargeback mechanism in bad faith.

7.7 One account per person is permitted. You alone are responsible for the confidentiality of your login credentials and for all activity that occurs through your account.

7.8 Any use of the Platform that violates the laws of the United Arab Emirates, public morals, or the rights of others is prohibited.

7.9 We reserve the right, at our sole discretion and without prior notice, to suspend or terminate any account, withhold or forfeit any tokens, and refuse service, upon any violation of this section or reasonable suspicion of one, with no obligation to refund any amounts.

8. Tokens and Payments

8.1 Tokens (credits) are a limited, personal, non-exclusive license to use the search feature within the Platform only. They have no cash or monetary value and are non-transferable, non-tradable, and non-redeemable for cash.

8.2 Each search consumes a number of tokens as indicated within the Platform. New users receive two (2) free tokens, and token packages are sold in UAE dirhams.

8.3 All payments are processed through the payment provider Lemon Squeezy acting as Merchant of Record. The payment process is subject to that provider's terms and policies, in addition to these Terms.

8.4 Tokens are non-refundable as a general rule. We grant refunds only in narrow cases and at our sole discretion, such as a confirmed technical failure in our system that resulted in no search result being displayed despite a token being deducted.

8.5 We may change prices or the composition of packages at any time. Free tokens are promotional in nature, and we may modify, revoke, or discontinue them at any time without notice.

9. Intellectual Property

9.1 Everything relating to the Platform, including its design, text, source code, interfaces, marks, visual identity, and the arrangement and organization of content, is owned by or licensed to the Platform and is protected under applicable intellectual property laws.

9.2 The user is granted a limited, personal, non-exclusive, non-transferable, and revocable license to use the Platform for personal, non-commercial purposes only, and in accordance with these Terms.

9.3 The names, logos, and trademarks of the airlines (Emirates / Etihad Airways) are owned by their respective owners. They are used on the Platform nominatively for identification and comparison purposes only, which implies no affiliation, sponsorship, endorsement, or connection between us and them.

10. Third-Party Content and Links

10.1 The Platform may contain links or references to third-party sites and services, such as airline websites and data providers. These sites are outside our control.

10.2 We bear no responsibility for the content, services, prices, policies, or practices of those sites, and your dealings with them are at your sole risk and subject to their terms.

11. Privacy (Brief)

11.1 We collect and process limited data to operate the service, including: your email address, your password in hashed form, your search history, your token balance, and payment records (which are held by the payment provider). We use this data to provide, secure, and improve the service.

11.2 We handle personal data in accordance with the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021). We do not sell your personal data. (This is a brief summary only and does not replace a full privacy policy.)

12. Changes to Terms

12.1 We may update or amend these Terms at any time. We indicate the last-updated date at the top of this document.

12.2 Your continued use of the Platform after any amendment is published constitutes your acceptance of the amended Terms. If you do not agree, stop using the Platform.

13. Governing Law and Jurisdiction

13.1 These Terms are governed by and construed in accordance with the laws of the United Arab Emirates.

13.2 The competent courts of the United Arab Emirates (the courts of the Emirate of Dubai) shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
